1. Acceptance of Terms

By accessing and using the services provided by PT Curagi Global Informatika ("Curagi", "we", "us"), including our website at curagi.io and all related software products, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Curagi provides custom healthcare information systems powered by Big Data, Artificial Intelligence, and IoT technologies. Our services include but are not limited to:

  • Health Information Systems (HIS) for hospitals and clinics
  • Healthcare Management Systems (HMS) for healthcare service operations
  • Academic & Education Systems (AES) for health education institutions
  • Custom software development for healthcare organizations
  • SaaS subscription services for healthcare IT solutions
  • Managed hosting and maintenance services

3. User Accounts

To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate, current, and complete information during the registration process. We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

4. Intellectual Property

All intellectual property rights in our services, including software, designs, trademarks, and content, are owned by PT Curagi Global Informatika or its licensors. The specific intellectual property rights transferred to you depend on your engagement model:

  • Full Purchase: You receive ownership of the source code developed specifically for your project. Curagi retains rights to its core frameworks and libraries.
  • Purchase + Managed: You own the application while Curagi retains rights to manage, update, and maintain the underlying infrastructure.
  • SaaS Subscription: You are granted a non-exclusive license to use the software during the subscription period. No ownership of source code is transferred.

5. Payment Terms

Payment terms are specified in the individual service agreement or order form. We accept payments through PayPal and Xendit. All fees are non-refundable unless otherwise stated in writing.

For SaaS subscriptions, fees are billed in advance on a monthly or annual basis. Failure to pay may result in suspension or termination of your access to the services.

6. Data Protection

We take data protection seriously. All our applications are designed and built following ISO 27001 information security management principles. Our data handling practices are described in our Privacy Policy.

For healthcare data, we comply with applicable regulations in the jurisdictions where our clients operate, including Indonesian health data regulations (PP 46/2014 on Health Information Systems) and other relevant ASEAN data protection frameworks.

7. Service Level Agreement

For managed and SaaS services, we commit to a 99.9% uptime SLA. Scheduled maintenance windows will be communicated at least 48 hours in advance. In the event of unplanned downtime, we will provide timely updates and work to restore services as quickly as possible.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Curagi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claim arising from these terms or our services shall not exceed the amount paid by you for the services during the twelve (12) months preceding the claim.

9. Termination

Either party may terminate the service agreement with 30 days written notice. We reserve the right to immediately terminate or suspend access to our services for violations of these terms, non-payment, or illegal activities.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these terms shall be resolved through the District Court of Central Jakarta, unless otherwise agreed upon by both parties.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or through a notice on our website. Your continued use of our services after such changes constitutes acceptance of the updated terms.
